Do AI Avatar Ads Need a Disclosure? In New York Now, California in January
Yes, if a generated or stock AI avatar is selling something to people in New York or California. New York has required the label since June 9, 2026. California signed its version, SB 1050, on September 16, 2026, and it takes effect January 1, 2027. If your ad’s presenter was rendered rather than filmed, and that presenter isn’t a real, identifiable person, the ad has to say so.
This is an operator’s read of two statutes, not legal advice. If ads are a real revenue line for you, have a lawyer look at your setup.
What the two laws cover
| New York (GBL § 396-b) | California (SB 1050) | |
|---|---|---|
| In force | June 9, 2026 | January 1, 2027 |
| Covers | Visual and audiovisual ads | Video and audio ads |
| “Synthetic performer” | AI-made figure that reads as a human performer but isn’t an identifiable real person | Same idea: AI-made figure or voice that reads as human, not an identifiable real person |
| Who’s on the hook | Whoever produces or creates the ad, with actual knowledge a synthetic performer is in it | Treated as false advertising; a violating ad has to be pulled or fixed, not left to run |
| Penalty | $1,000 first violation, $5,000 each after | Enforced under California’s false-advertising law |
California only bites when the synthetic performer is prominent: out front demonstrating the product, delivering the narration or pitch, or reacting to it. A blurred figure in the background isn’t the target. An avatar reading your script to camera is.
The label California asks for is short. Language substantially similar to “this performance features a synthetic performer” or “no human performer is depicted,” placed where a reasonable viewer can’t miss it.
Where your stack lands
Stock avatars and generated presenters. In scope in both states. If you use one of HeyGen’s or Synthesia’s library avatars to pitch a product, that’s the exact case these laws were written for.
A digital twin of you. Narrower. Both definitions exclude a replica of an identifiable real person, so your own cloned avatar selling your own offer isn’t what these two statutes are aimed at. That doesn’t make it label-free. The FTC still expects affiliate relationships disclosed, YouTube asks creators to flag realistic synthetic content, and the EU’s Article 50 covers synthetic video whether or not the face is yours. We cover that one in the EU AI Act guide.
A cloned or generated voice. California’s definition includes a voice, and SB 1050 covers audio ads. A synthetic narrator from ElevenLabs on a podcast ad read counts the same way a face does.
Translation only. California exempts ads that use AI solely for language translation. Dubbing a real person’s ad into Spanish isn’t a synthetic performer.
The operator move
Don’t sort ads into “probably fine” and “probably not.” Label every one where a person on screen or on mic wasn’t recorded. It costs one line of on-screen text, and it answers New York, California, the FTC, and your platform in the same breath.
Then take it out of the checklist and put it in the template. The avatar export preset carries the label. The caption style has it baked in. The publish step in your automation refuses to fire without it. Disclosure that depends on remembering fails on the busy week.
The map comes before the automation. Here, the map is one column: which seats put a synthetic person in front of a buyer.
